ONE (1) YEAR LIMITED WARRANTY

NOT APPLICABLE FOR TEE BALL BATS. IF YOU HAVE A TEE BALL BAT, PLEASE USE Warranty Claim Form

Under this limited warranty, Franklin Sports, Inc. (“Franklin”) will provide original purchasers who purchase directly from Franklin Sports or one of its authorized resellers a one-time repair or replacement of your non-wood youth bat within one (1) year from date of purchase for the following conditions resulting from normal use: (1) severe denting; (2) structural cracking; (3) handle bending; or (4) broken end caps or knobs.  If your bat experiences any of these conditions, you should immediately discontinue use of the bat and submit a warranty claim.

THIS WARRANTY DOES NOT COVER:

- Tee Ball Bats

- Normal wear and tear

- Cosmetic damage, such as scratches or dents that do not affect the performance of the bat

- Bats used as team bats by multiple players

- Bats used in commercial batting cages

- Bats that were not purchased from an authorized dealer or that have been transferred from the original purchaser

- Bats that have been used in temperatures below 60 degrees Fahrenheit (15 degrees Celsius)

- Grip replacements

- Bats that have been subjected to misuse, abuse, modification or alteration (including rolling, shaving or other unauthorized actions that change the physical properties of the bat) or failure to follow care instructions set forth below

- Bats with removed or defaced date codes

- Do not hit metal cleats, rocks or any other objects other than regulation game balls with the bat.

- Use only mild soap and water to clean your bat. Do not use solvents or ammonia-based products.

- Do not use your bat in temperatures lower than 60 degrees F / 15 degrees C.

- Rotate the bat 1/4 turn at each at-bat

- This bat is designed for individual use. It should not be used as a team bat for multiple players.

- Bats should be replaced approximately every two years with normal usage.

- Inspect your bat frequently for cracks, nicks, dents, surface damage or excessive wear.  DO NOT USE BAT IF EXCESSIVELY WORN OR DAMAGED.

1. DO NOT RETURN YOUR BAT TO THE SPORTING GOODS DEALER WHERE IT WAS PURCHASED. All warranty claims must be made directly to Franklin using the procedures described below.

2. Fill out our online Warranty Claim Form (see below). You will be required to upload images of your bat and your original receipt for the purchase of the bat from an authorized Franklin dealer.

3. You will receive a return authorization number and instructions on how to send your bat to Franklin.

4. Ship the bat to Franklin using the pre-paid shipping label we will provide.

5. If Franklin determines that your bat is eligible for the warranty, then Franklin will at its sole option and in its sole discretion either (a) repair your bat; (b) replace your bat with the same model bat; (c) replace your bat with a comparable bat in the event that the model you purchased is unavailable; or (d) provide you with a gift certificate to be used toward the purchase of other Franklin products on the www.franklinsports.com web site.

6. If Franklin determines that your bat is ineligible for the warranty, the bat will be returned to you with an explanation of the reason for warranty ineligibility.

In the interest of resolving potential disputes between us in the most expedient and cost-effective manner, you and Franklin agree that any and all disputes arising in connection with this product (whether claims are based in contract, tort, statute, fraud, misrepresentation or any other legal or equitable theory) will be resolved by binding arbitration. Arbitration is a more informal procedure than a lawsuit that is filed in court. In arbitration, a neutral arbitrator will decide the case instead of a judge or jury. Arbitration may result in more limited discovery than a court proceeding and may not afford the same opportunities for review of decisions. YOU UNDERSTAND AND AGREE THAT BY ACCEPTING THE TERMS OF THIS WARRANTY, YOU AND FRANKLIN ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, A PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

Notwithstanding the foregoing, you may pursue an individual claim in small claims court in your county of residence within the United States or in Norfolk County, Massachusetts. In such case, the provisions of this section will not apply.

CONSEQUENTIAL AND INCIDENTAL DAMAGES ARE NOT RECOVERABLE UNDER THIS WARRANTY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY FOR THIS PRODUCT AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
